JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 08-06-2020 Heard learned counsel for the petitioners and learned learned Additional Public Prosecutor for the State. The petitioners are in custody in connection with Shahpur P.S. Case No. 437 of 2019 for the offenses under 302,201/34 of the Indian Penal Code.
In this case case diary was called for by order dated 3.2.2020 which has been received.
Learned counsel appearing on behalf of the petitioners would submit that the petitioners have no criminal antecedent. Referring to the prosecution case learned counsel submits that the specific allegation is against co-accused Sunil Rai and Niranjan Rai who have stabbed knife to her husband. From
Patna High Court CR. MISC. No.5894 of 2020(5) dt.08-06-2020 2/2 perusal of the case diary it does not appear that there is specific material to suggest that these petitioners have given fatal blow. The petitioners are in custody since 2.11.2019. Considering the facts and circumstances of the case, the Court is inclined to grant bail to the petitioners. Let the petitioners, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the ACJMI, Danapur in connection with Shahpur P.S. Case No. 437 of 2019, subject to the condition that on release the petitioner shall render his services as volunteer to combat the pandemic of Covid-19 for a period of one month. He is required to report to the Civil Surgeon/ Nodal Officer, Covid-19, Patna, who shall utilize his services appropriately.
