Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Initially, the case was registered under Sections 302, 120B, 201/34 of the Indian Penal Code but after completion of the investigation, police submitted charge sheet under Section 306 of the Indian Penal Code.
The informant claimed that deceased had illicit relation with petitioner and a Panchayati was convened in respect of the aforesaid illicit relation and that was the reason deceased was killed by the petitioner as well as other F.I.R. named accused persons. In course of investigation, witnesses supported the
Patna High Court Cr.Misc. No.14771 of 2016 (2) dt.18-04-2016 2/2 aforesaid fact but police found the aforesaid accusation untrue and came to conclusion that deceased committed suicide. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Sahiyara P.S. Case No. 90 of 2015.
