At the outset, the learned counsel for the petitioner seeks to correct the prayer mentioned in paragraph no. 10 of the present bail petition.
Permission is granted.
Let the correction be made during the course of the day.
The petitioner seeks regular bail in connection with Nadi P.S. Case No. 229 of 2018 registered for the offence punishable under Sections 461 and 379 of the Indian Penal Code.
The allegation is regarding the informant having heard some noise coming from his godown whereafter upon
Patna High Court Cr.Misc. No.2847 of 2019(2) dt.22-01-2019 2/2 enquiry it transpired that thieves had come there for the purposes of stealing articles from the godown and subsequently the petitioner is said to be one of the co-accused who was apprehended from the spot.
The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and he is having a clean antecedent as also he is languishing in custody since 03.11.2018.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Patna City in connection with Nadi P.S. Case No. 229 of 2018.
