2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 274 and 275 of the B.N.S. and Sections 30(a) and 45 of the Bihar Prohibition and Excise (Amendment) Act.

3. As per prosecution case, 50 litres country made liquor has been recovered from bank of Jhakiya river.

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is innocent and has falsely been implicated in this case merely on suspicion. No incriminating article has been recovered from conscious possession of this petitioner. The alleged illicit liquor has been recovered from an open place.

5. On the other hand, learned A.P.P. for the State has
