The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 420, 406 and 409 of the Indian Penal Code.
Submission is that the petitioner was Awas Sahayak and allegation is that he was involved in transfer of the money of one beneficiary into account of another beneficiary. Submission is that matter was inquired by the authorities. Rokhashana Khatun, wife of Mounudin Ansari was also a claimant and fund was sanctioned in her favour also. Therefore, this may be a case of bona fide mistake of payment to Moin Ansari instead of Mounudin Ansari as alleged. Moreover, the payment of amount is made by the Block Development Officer, Deo and not by the petitioner.

No.5590 of 2019(2) dt.31-01-2019 2/2 Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending in connection with Deo Police Station Case No. 145 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
