JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-06-2020 Heard learned counsel for the petitioner, learned counsel of opposite party no. 2 as well as learned Additional Public Prosecutor for the State through video conferencing. Petitioner seeks bail in a case registered for the offences punishable under Sections 406, 409, 420, 467, 468, 471, 120(B) of the Indian Penal Code.

Petitioner was working as Assistant in the concerned bank at the relevant time and allegedly, huge amount of bank was defalcated.

Learned counsel of the petitioner submits that concerned Manager as well as Manager of Customer Care Center have already been granted privilege of bail by different

No.7988 of 2020(5) dt.22-06-2020 2/2 Benches of this court and the case of this petitioner stands on similar footing to that of co-accused persons but I am not at all convinced with the above stated submission of learned counsel of the petitioner. Petitioner being Assistant in the concerned bank was responsible for making entries in the relevant registers and it is obvious from perusal of record as well as case diary that defalcation has been committed by making fake entries in the relevant registers of the bank.

Therefore, in my view, petitioner does not deserve the privilege of bail. Accordingly, his prayer for bail in connection with Sheikhpura (Sirari O.P.) P.S. Case No. 762 of 2018 stands rejected.
