JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-08-2019 This is an application for grant of anticipatory bail in connection with Kankarbagh P.S. Case No. 511 of 2017, disclosing offences under Sections 498(A)/379/34 of the Indian Penal Code.

Allegation against the petitioner is of demand of dowry and also subjecting of assault and torture. It appears that after appearance of O.P. No.2 the matter was referred to the mediation centre but the mediation was failed. Submission of learned counsel for the petitioner is that the O.P. No.2 is herself a teacher and the petitioner is a LIC agent and due to exorbitant demand by O.P. No.2 the settlement could not made but he is ready to pay a sum of Rs. 5,00,000/- to

Having heard both sides, in view of the submissions, of the petitioner that he is ready to deposit Rs. 5,00,000/- by way of bank draft in the name of Archit Kumar son of O.P. No.2 and O.P. No.2 has accepted that she will fix the amount in the name of Archit Kumar for his better study. Let the petitioner above named, in the event of their arrest or surrender before the court below within six weeks, with a bank draft of Rs. 5,00,000/- by way of bank draft in the name of Archit Kumar, he will be released on bail on furnishing bail bond of Rs.25,000/-(Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Judicial Magistrate, Ist Class, Patna in connection with Kankarbagh P.S. Case No. 511 of 2017, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.

It is also made clear that the above bank draft deposited before the court shall be released in favour of the O.P. No.2 with a direction to fix the amount in the name of Archit Kumar for his better study.
