JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-08-2021 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 409, 406, 419, 420, 120B, 34 of the Indian Penal Code.

As per the prosecution case, this petitioner along with Smt. Sanju Devi misappropriated government money of Rs. 26,12,500/- which was allotted to the petitioner for completing work of Mukhya Manti Gramin Payjal Nishchay Yojna. Learned counsel appearing for the petitioner submits that although the work was allotted to the petitioner but the entire work was being done by the Mukhiya and Panchayat Sachiv of the Panchayat and petitioner is an illiterate man and he has not misappropriated any Government money and he is victim of circumstances. Learned counsel appearing for the State opposes the prayer for bail and submits that without completing the work of Mukhya Mantri Gramin Payjal Nishchay Yojna this petitioner and another co-accused withdrew Rs. 26,12,500/- and defalcated the entire Government money.

Considering the facts of the case and nature of allegation, I am not inclined to enlarge the petitioner on bail, at this stage. Accordingly, the same is rejected. The trial court is directed to conclude the trial as soon as possible.
