Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-302/34, 120(B) of the Indian Penal Code and 27 of the Arms Act.

Petitioner is not named in the first information report. The informant claims himself to be eye witness of the alleged occurrence and specifically, stated that it were co-accused Amit Kumar @ Mannu and Balram Kumar who shot fire on the deceased. In course of investigation, co-accused Amit Kumar @

Patna High Court Cr.Misc. No.14653 of 2016 (2) dt.08-04-2016 2/2 Mannu disclosed the name of the petitioner and stated that the petitioner was also his associate.

Even if, the aforesaid confessional statement of coaccused, Amit Kumar @ Mannu assumed to be true, then also, petitioner does not happen to be assailant.

Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Teghra P.S. Case No. 217 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Begusarai. (Hemant Kumar Srivastava, J) A.K.V./- U T
