The petitioner is aggrieved with the encroachment of his land appertaining to Thana No. 66, Khata No. 26, Plot No. 1128 by one Dilip Shrivastava and Dheeraj Shrivastava. It is submitted by learned counsel for the petitioner that the land in question was settled in the name of the wife of petitioner, namely, Nirmala Devi since the petitioner is a landless person but the same has been encroached upon. Since the encroachment has been made by private persons on the land of the petitioner, moreover, the private persons have not been made party respondents, this Court is not inclined to interfere in the matter.
However, learned counsel for the petitioner seeks
Patna High Court CWJC No.7222 of 2017(2) dt.06-03-2018 2/2 permission to withdraw this writ application with a liberty to take recourse to remedy in accordance with law. This writ application is permitted to be withdrawn with the liberty aforesaid.
