The petitioner seeks regular bail in Patahi Police Station Case No. 60 of 2020 registered for the offences punishable under sections 302/34 and other allied sections of the Indian Penal Code.

As per the prosecution case, petitioner used to come to the house of the informant and he made illicit relation with her daughter-in-law. It is further alleged that on 1.4.2020, the petitioner and informant's daughter-in-law Seema Devi both set her son on fire causing his death during course of treatment. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this

There is no substantive evidence to suggest the implication of this petitioner in the present case. Petitioner has got clean antecedent as stated in paragraph 3 of the bail petition. Petitioner is in custody since 9.7.2020. Learned counsel for the State and the informant oppose the prayer for bail and submit that informant's son had seen the petitioner and said Seema Devi in a compromising condition, so they burnt him.

Considering the nature of allegation and gravity of the offence, prayer for bail of the petitioner is refused. (Prabhat Kumar Singh, J) shashi/- U T
