JUSTICE SANDEEP KUMAR ORAL ORDER 16-05-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks regular bail in connection with Chanpatiya (Sirsiya O.P.) P.S. Case No. 452/2018, registered for the offence punishable under Sections 302, 201, 404/34 of the Indian Penal Code.

The allegation against the petitioner is that he is in conspiracy with other person in killing the informant's son by strangulating his neck.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Petitioner has no criminal antecedent. Similarly situated co-accused namely Mithun Alam has been granted bail by a co-ordinate

Patna High Court CR. MISC. No.5964 of 2023(4) dt.16-05-2023 2/2 Bench of this Court vide order dated 02.05.2023 passed in Cr. Misc. No. 7828 of 2023. Petitioner is in custody since 23.09.2022.

Learned APP has vehemently opposed the prayer for bail.

Considering the nature of allegation levelled against the petitioner, his period of custody, this application is allowed. Let the petitioner, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the C.J.M., Bettiah, West Champaran in connection with Chanpatiya (Sirsiya O.P.) P.S. Case No. 452/2018.
