JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-376(D)/379 of the Indian Penal Code . Two co-accused persons were caught on the spot, just after the alleged occurrence of gang rape and the aforesaid apprehended co-accused disclosed the name of petitioner and one, Pawan Kumar as their associates.
Submission on behalf of petitioner is that co-accused, Pawan Kumar has already been granted privilege of bail by a coordinate bench of this court and the case of petitioner is on similar footing to that of co-accused, Pawan Kumar. It is further alleged that moreover, petitioner is in jail custody since 31-07-
Patna High Court Cr.Misc. No.14031 of 2016 (2) dt.05-04-2016 2/2 2015 but it appears from perusal of the impugned order that petitioner has not been put on Test Identification Parade as yet. Considering the above-said facts and circumstances of the case as well as submission of the parties, particularly, to maintain the parity of justice, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Sultanganj P.S. Case No. 147 of 2015 corresponding to Sessions Trial No. 631 of 2015 to the satisfaction of Learned Additional Sessions Judge-Ist, Bhagalpur.
