====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 21-06-2022 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 30(a) of the Bihar Prohibition & Excise Act. There is recovery of 500 litres of Indian made Foreign Liquor from the house of the petitioner. It is submitted by learned counsel for the petitioner that recovery has been made from the joint family house. The petitioner has falsely been implicated in this case at the instance of local Chaukidar with whom there is an enmity from before with regard to the service

Patna High Court CR. MISC. No.14684 of 2021(15) dt.21-06-2022 2/2 lane. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Learned A.P.P has vehemently opposed the prayer for anticipatory bail of the petitioner and stated that recovery has been made from the house of the petitioner.

Considering the fact that petitioner is owner of the house from which huge quantity of Indian made Foreign Liquor was recovered, this Court is not inclined to grant privilege of anticipatory bail to the petitioner. The prayer for grant of anticipatory bail to the petitioner stands rejected.
