The petitioners apprehend their arrest in Khanpur P.S. Case No. 55/2016, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. The informant named nine persons and alleged that they assaulted the informant and others.

Learned counsel for the petitioners submits that from the side of petitioners Khanpur P.S. Case No. 54/2016 was registered. There is general and omnibus allegation against the petitioners on account of land dispute. Both sides entered into mutual assault. The injuries are simple in nature.

No.23875 of 2017 (2) dt.14-07-2017 2/2 Considering the facts aforesaid and the fact that there is case and counter case, many persons got injured, but the injuries are simple in nature, the petitioners above named in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate III, Samastipur in connection with Khanpur P.S. Case No. 55/2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
