JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section-376 of the Indian Penal Code.

Petitioner is said to have committed rape upon 8 years old girl who supported the incident in her statement, recorded u/S 164 of the Cr.P.C. and above all, the medical report also corroborates the allegation of rape.

Regard being had to the facts and circumstances of the case as well as submission of the parties, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Mahnar P.S. Case No. 195 of 2013 pending in the court of Learned Additional Sessions Judge-Ist, Vaishali at Hajipur stands rejected.
