The petitioner seeks anticipatory bail in connection with Kuchhila P.S.Case No. 21 of 2018, registered for offences punishable under Sections 354B of the Indian Penal Code. The allegation against the petitioner is of misbehaving with the informant.

Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case and witnesses have not supported the prosecution case as he was already on police bail and he has not misused the privilege of bail. It is also submitted that the petitioner has no criminal antecedent. Learned A.P.P. opposed the prayer for bail.

Having heard both sides and in view of the facts and circumstances discussed above, let the petitioner, above named,

Patna High Court CR. MISC. No.5571 of 2019(3) dt.27-03-2019 2/2 surrender before the Court below and make prayer for regular bail, which will be considered by the learned court below considering that earlier the petitioner was on police bond before the police, he has not misuse the same and will dispose of the prayer for bail, if possible on same day.

This application is accordingly disposed of on the same date.
