JUSTICE SUDHIR SINGH ORAL ORDER 06-07-2015 The petitioner is languishing in custody since 28.11.2014 in connection with Deoriya P.S. Case No. 57 of 2014 for the offences instituted under Sections 20 and 22 of the N.D.P.S. Act.

Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that on 12.06.2014 he got an information that a person in suspicious condition with some Charas in the mango orchard in Chandpura village behind the house of one Anuj Singh belonging to Ram Chandra Singh. On this information being arranged a raiding party, reached there and arrested a person who disclosed his name Sandeep Kumar and two persons fled away about whom he told the name of the petitioner

Patna High Court Cr.Misc. No.24033 of 2015 (2) dt.06-07-2015 2/2 Satendra Yadav and Akhilesh Yadav. From possession of Sandeep Kumar Charas like substance weighting 750 grams is alleged to be recovered for which he did not produce any paper. The detail statements are made in the written report.

It has been submitted on behalf of the petitioner that nothing is said to have been recovered from possession of the petitioner. Recovery is said to have been made from possession of one Sandeep Kumar Paswan. The name of the petitioner has figured on the confession of said Sandeep Kumar Paswan. It is further submitted that other co-accused has been granted bail vide Annexure-2 to the present application. It is further submitted that the petitioner is in custody since 28.11.2014. On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Muzaffarpur, in connection with Deoriya P.S. Case No. 57 of 2014.
