The petitioner seeks bail in Madhepura P.S. Case No. 828 of 2020 corresponding to Excise Case No. 826 of 2020, registered for the offence punishable under Sections 8(C)/21(C)/22(C)/24/25 of the Narcotic Drugs and Psychotropic Substances Act and section 30(a) of the Bihar Prohibition & Excise Act, 2016.

As per the prosecution case, 70 litres of Codeine cough syrup kept in 700 bottles has been recovered from the shop and rented godown of the petitioner.

It is submitted on behalf of the petitioner that petitioner runs a medical shop having valid license issued under Drugs and Cometic Act on 30.07.2020. No narcotic substance

Patna High Court CR. MISC. No.7090 of 2022(2) dt.07-04-2022 2/2 has been recovered from possession of this petitioner. Petitioner claims clean antecedent and he is in custody since 27.09.2020. Investigation is complete.

Considering the period of custody and clean antecedent, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II-cumSpecial Judge Excise Act, Madhepura in connection with Madhepura P.S. Case No. 828 of 2020 corresponding to Excise Case No. 826 of 2020.
