JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-04-2016 Heard learned counsel for the petitioner, learned Additional Public Prosecutor for the State and learned counsel, appearing for the informant.

Petitioner seeks bail in a case registered under Sections-364(A), 363, 120(B) of the Indian Penal Code. Petitioner is not named in the first information report but in course of investigation, one co-accused Ravi Shankar Singh was arrested and made his confessional statement, disclosing the involvement of the petitioner in the alleged crime. After the aforesaid confessional statement of co-accused, petitioner was arrested and he, too, made his confessional statement. It appears that except the confessional statement of co-accused as well as the petitioner, there is nothing against him. Moreover, the victim has nowhere stated the name of the

The petitioner is languishing in jail custody since 30-11-2015 and the investigation against him has already been completed. Considering the above-said facts and circumstances of the case as well as submission of the parties and also taking note of this fact that petitioner does not have any criminal antecedent, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Gopalganj (Town) P.S. Case No. 456 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Gopalganj.
