Ms. Asha Kumari, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 10-03-2021 This modification application has been filed seeking modification of the order dated 09.01.2020 passed in Cr. Misc. No. 85284/2019.

In Cr. Misc. No. 85284/2019 there were altogether eight petitioners. This Court vide order dated 09.01.2020 allowed the prayer for bail of the petitioner giving them four weeks time to surrender and furnish bail bonds. Learned counsel for the petitioners in the present application submits that these petitioners could not surrender in the learned court below within the time fixed by this Court for the reasons that both of them were in the foreign country and though they were all prepared to come to India, due to the

Patna High Court CR. MISC. No.15381 of 2021(3) dt.10-03-2021 2/2 Covid-19 situation they could not travel.

For the reasons stated in this application, this Court is satisfied that the petitioners deserve the modification of the order. Accordingly, it is directed that in case the petitioners surrender and submit their bail bonds within three weeks from today, the same would be accepted and they will be entitled for the benefits conferred by the order dated 09.01.2020 passed in Cr. Misc. No. 85284/2019.

Learned counsel for the petitioners further submits that in the name of petitioner no. 1 namely, Chhotu Singh @ Jaiprakash Singh, a modification is required whereunder his alias name be allowed to be inserted.

Let the name of petitioner no. 1 be read as "Chhotu Singh @ Jaiprakash Singh @ Jay Prakash Singh" as mentioned in the Interlocutory Application filed in the present case. Rest of the order shall remain intact.

This Modification Application stands disposed off accordingly.
