24-08-2021 Heard learned counsel for the parties through video conferencing.

The petitioner seeks bail in Belhar P.S. Case No. 306 of 2020, registered for the offence under Section 302 / 34 of the Indian Penal Code.

As per the prosecution case, the daughter of the informant was married with petitioner in the year 2013 and thereafter, she was blessed with two children. It is further alleged that after the marriage, this petitioner alongwith other co-accused persons tortured the daughter of the informant for demand of dowry and due to non-fulfillment of the same, on 17.08.2020, the informant got an information that his daughter and natini were done to death by all accused persons. It is submitted that petitioner has been falsely

In fact, the deceased had some illicit relation with her brother-in-law (behnoi), which was objected by this petitioner and as a result of which, she committed suicide. Petitioner is in custody since 18.08.2020.

However, learned A.P.P. for the State opposed the bail petition and submitted that petitioner is husband of the deceased and there is specific allegation of demand of dowry. Deceased has died in an unnatural circumstances at her matrimonial home. Considering the nature and gravity of offence and the fact that petitioner is husband of the deceased, I am not inclined to grant bail to the petitioner and same is, accordingly, rejected.
