The petitioner seeks bail in connection with Jamhore P.S. Case No. 99 of 2021 instituted for the offences under Section 30(a) of the Bihar Excise Act.
Learned counsel for the petitioner submits that the petitioner is in custody since 11.12.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that the allegation is of recovery of 555 litres of liquor from the place of occurrence.
Learned counsel for the petitioner submits that the petitioner was not arrested from the spot and his name was
Patna High Court CR. MISC. No.4852 of 2022(2) dt.07-03-2022 2/2 disclosed by the Chowkidaar with whom he is on an inimical term.
Learned A.P.P. for the State opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody, is a person with clean antecedent, charge-sheet has been submitted in the case and was not arrested from the spot, let the petitioner above named be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-II-cum-Special Judge, Excise, Aurangabad in connection with Jamhore P.S. Case No. 99 of 2021. (Satyavrat Verma, J) Rishi/- U T
