The petitioner is in custody in a case registered under Sections 341, 323, 436, 504/34 of the Indian Penal Code. The prosecution case in, brief, is that the informant Shobhi Sah has stated that on 29.4.2014 he along with Jagruk Manjhi were repairing his house, in the meantime, at about 12.30 noon Shanker Yadav and Shri Yadav came and abused him by saying why they are doing wok of chheni in his land. Shri Yadav claimed on the roof and snatched sickle from the hand of Jagruk Manjhi and started Hatha Payee with his wife and Shankar Yadav set fire in the house. It is stated by the informant that he has been living in the house since last ten years.

Patna High Court Cr.Misc. No.24007 of 2015 (2) dt.06-07-2015 2/2 It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in the present case. It is further submitted that the land, in question, has been purchased by the wife of the petitioner from Bhabhi of the informant. The sale deed dated 5.1.2011 is Annexure- 2 to the present application. The petitioner has got no criminal antecedent and is in custody since 4.4.2015.

On behalf of the State it has been submitted that the petitioner is named in the FIR.

Considering the facts aforesaid, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Shyamal Kumar, Judicial Magistrate, 1st Class, in Barhat P.S.Case No. 20/2014.
