No doubt, there is allegation that petitioner earlier established physical relation with the victim but according to the prosecution case itself, the victim went missing from the house of the informant. The impugned order shows that the victim has not been recovered as yet but petitioner is in jail custody since 17.02.2016 and there is nothing in the first information report to show that it was petitioner, who kidnapped the victim. Moreover, the informant lodged this case after 40 to 50 days of the alleged

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kishanganj in connection with Sukhani P.S.case No. 07 of 2015.
