The petitioner seeks bail in Mokama P.S. Case No. 229 of 2018, instituted for the offence under Section(s) 363 and 366 of the Indian Penal Code.
Counsel for the petitioner submits that victim girl on recovery has given statement under Section 164 Cr. P.C. wherein she has stated that she has voluntarily performed marriage with the petitioner. Later on she learnt that petitioner has already been married and has three sons.
In the statement of victim girl recorded under Section 164 Cr. P.C. she has stated her age as 18 years. The court has assessed her age to be 18 years.
Patna High Court Cr.Misc. No.7183 of 2019(2) dt.07-02-2019 2/2 Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Barh, Distt.
