JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-04-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act. Petitioners are not named in the first information report and informant claims himself to be eye witness of the alleged occurrence stating that F.I.R. named accused committed the murder of the deceased. The fardbeyan of the informant was recorded on 11.4.2008, but subsequently, the wife of the deceased filed complaint case after two months of the institution of the present case and the aforesaid complaint case was converted into Munger (Muffasil) P.S. Case No.281 of 2009. The wife of the deceased claimed that petitioners and other named accused of
Patna High Court Cr.Misc. No.15107 of 2016 (2) dt.12-04-2016 2/2 Munger (Muffasil) P.S. Case No.281 of 2009 committed the murder of the deceased and on the basis of aforesaid allegation, the petitioners were made accused in this case. Considering the aforesaid facts and circumstances as well as submissions of the parties, let petitioners above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of C.J.M., Munger in connection with Munger (Muffasil) P.S. Case No.83 of 2008.
