JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 03-11-2022 Heard learned counsel for the petitioner and Mr. Manoj Kumar, learned AC to GP-4 for the State. By filing this writ application about 51⁄2 years back the petitioner prayed for a direction to the respondent authorities to provide adequate protection of his life, liberty and property. A perusal of the writ application would show that the petitioner claims ownership in respect of certain land and in respect of the said land section 144 Cr.P.C. proceeding was also initiated. Petitioner admits his dispute over the land with the private respondents.

WJC No.740 of 2017(2) dt.03-11-2022 2/2 Learned counsel for the State submits that taking note of the grievance of the petitioner the concerned officer-in-charge of the police station submitted a report for initiation of a proceeding under Section 107 Cr.P.C. and accordingly said proceeding was initiated. It is further stated that besides initiation of a proceeding the police is also watching the parties connected with the aforesaid dispute and in case of a breach of peace by either of the parties, suitable action shall be taken. In the given facts and circumstances of the case, this Court is of the considered opinion that at this stage no further direction need be issued to the respondents. If the circumstances so arise, the petitioner is always at liberty to submit an application to the Superintendent of Police, Siwan (Respondent No.3) and in case it is found that his life and liberty is in danger, respondent no. 3 shall consider the same and pass an appropriate order thereon within a reasonable period.
