Mr.Madhaw Pd. Yadaw (Gp23) ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 17-02-2020 Heard learned counsel for the petitioner, the State and Municipal Council, Sasaram.

The grievance of the petitioner in the present writ petition is inaction on the part of the Municipal Council, Sasaram in the matter of appointment on the post of Librarian on sanctioned vacant post.

Learned counsel appearing on behalf of the petitioner submits that after the direction of the Apex Court steps were taken by the respondents but it has not been culminated in

Patna High Court CWJC No.1100 of 2020(2) dt.17-02-2020 2/2 appointment.

Mr. Sudama Singh, learned counsel for the Municipal Council submits that due to model code of conduct, appointment process has not been taken to its logical end. Mr. Singh submits that Municipal Council is taking steps for making appointment and there is no opposition to the claim of the appointment and it shall be made on the post of Librarian.

Considering the stand taken by the parties, the writ petition is disposed of with the direction to the Municipal Council, Sasaram to complete selection process and make appointment in accordance with law at the earliest preferably within a maximum period of three months from the date of receipt/production of a copy of this order.

With the aforesaid, the writ petition stands disposed of.
