JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 10-12-2021 Let the defects, as pointed out by the office, be removed when called upon to do so by the office. Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioners are apprehending their arrest in a case registered in connection with Saharsa Sadar P.S Case No. 98 of 2020 for the offences punishable under Sections 341, 323, 324, 379, 307, 504, 506, 447/34 of the Indian Penal Code. As per prosecution case, petitioners are Dewar of the informant and in drunken condition, they came at her door, abused and broke up the wall of the house and beaten her husband and son.

Patna High Court CR. MISC. No.17068 of 2021(2) dt.10-12-2021 2/2 Learned counsel for the petitioner submits that husband of the informant and petitioners are full brother. From perusal of the injury report, it appears that two persons namely, Lakhan Kumar and Rohit Kumar sustained injury which is annexed as Annexure-2 shows that all the injuries are simple in nature.

In the facts and circumstance of the case, let the petitioners , above named, in the event of their arrest or surrender before the Court Below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar P.S Case No. 98 of 2020 subject to the conditions as laid down under Section 438(2) of the Cr.P.C (Sunil Kumar Panwar, J) N.K/- U
