The petitioner seeks modification of the order dated 23.09.2021 passed by this Court in Criminal Appeal (SJ) No. 3576 of 2021. By the aforesaid order, the petitioner was directed to be enlarged on bail in the event of his arrest or surrender before the Court below within a period of eight weeks from the date of passing of the order. However for the reasons which have been explained in the petition, the petitioner could not surrender within the period mentioned in the order dated 23.09.2021. The order dated 23.09.2021 is modified to the

Patna High Court CR. MISC. No.4253 of 2022(2) dt.02-02-2022 2/2 extent that in case the petitioner surrenders before the court below within a period of six weeks from today, he shall be accorded the privilege under the order dated 23.09.2021 with the same terms and conditions.

The order stands modified to the extent indicated above.

The modification application stands disposed of accordingly.
