Learned counsel for the petitioner has submitted that inadvertently it has been mentioned in the bail petition that petitioner has no criminal antecedent.

Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in Town (Motihari) P.S. Case No. 575/2018, instituted for offences under Section(s) 413, 414/34 of the Indian Penal Code.

It is alleged in the written report that three persons including the petitioner were apprehended by the police along

Patna High Court Cr.Misc. No.3192 of 2019(3) dt.07-02-2019 2/2 with motorcycle. They could not produce any paper with regard to aforesaid motorcycle.

Learned counsel for the petitioner has submitted that petitioner was only riding on the aforesaid motorcycle. He has no concern with the motorcycle. There is no separate case lodged by anybody making claim of aforesaid motorcycle. Petitioner is in custody since 14.08.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Town (Motihari) P.S. Case No. 575/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
