Mr.A.G ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 07-01-2022 Heard Mr. Shailendra Kumar Singh, learned counsel for the petitioners and Mr. Sunil Kumar Pandey, learned APP for the State.

The petitioners seek bail in anticipation of their arrest in connection with Saharsa Sadar P. S. Case No. 912 of 2019, instituted for the offences under Sections 363 and 366 of the Indian Penal Code.

The informant's daughter was married to the brother of the petitioners but she was found missing for some time. It has, therefore, been suspected by the

Patna High Court CR. MISC. No.16332 of 2021(2) dt.07-01-2022 2/3 informant that the petitioners and his son-in-law have conspired to remove his daughter from the matrimonial home. Till date, the daughter of the informant is traceless.

The learned counsel for the petitioners has submitted that though they are the brothers of the sonin-law of the informant, but for the last several years, they have been staying separately and have got no concern with the affairs of Subhash Yadav (son-in-law of the informant) and his family.

This fact has come during the course of investigation.

Apart from this, it has been submitted that the son-in-law of the informant (husband of the victim) is in custody.

Considering the afore-stated facts, the petitioners, above-named, in the event of their arrest or surrender before the court below within a period of six weeks, are directed to be released on bail on their

No.16332 of 2021(2) dt.07-01-2022 3/3 furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sri K. K. Gupta, learned J.M., 1st Class, Saharsa, in connection with Saharsa Sadar P. S. Case No. 912 of 2019, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

This petition stands allowed.
