Case No.1300 of 2019, arising out of Sadar P.S. Case No.531 of 2019 registered for the offence punishable under Sections 30(a) and 32(2) of Bihar Prohibition and Excise Act, 2016. There is recovery of 43.200 litres of foreign liquor from the Bolero vehicle of the petitioners.

Submission of learned counsel for the petitioners is that petitioners have been falsely implicated in this case having no criminal antecedent. They are in custody for more than a month. Petitioners are ready to cooperate with the investigation. Heard learned APP also.

In view of above facts and circumstances, let

Patna High Court CR. MISC. No.4386 of 2020(2) dt.29-01-2020 2/2 petitioners be released on bail on furnishing bail bonds of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the learned 2nd additional Sessions Judge-cum-Special Judge, Excise Act, Darbhanga in connection with G.O. Case No.1300 of 2019, arising out of Sadar P.S. Case No.531 of 2019, subject to the condition that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the court concerned and further condition that they have to appear before the Investigating officer as and when required otherwise their bail bonds shall be cancelled.
