JUSTICE SUDHIR SINGH ORAL ORDER 06-07-2015 The petitioner is languishing in custody since 24.12.2014 in connection with Kotwali Tilkamanjhi P.S. Case No. 853 of 2014 for the offences instituted under Section 392 of the I.P.C.

Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that on 14.11.2014 at about 6.30 P.M. the informant was going from his shop at Zero Mile, towards Tilkamanjhi Chowk. As he reached near the gage of the Central Jail, three miscreants on a motorcycle snatched away his bag and the Tiffin. In the scuffle, one of the miscreants bit his hand. They also snatched away five to seven hundred rupees from

Patna High Court Cr.Misc. No.24107 of 2015 (2) dt.06-07-2015 2/2 his pocket. The motorcycle was of white colour and rambled Apache make. The informant then went his village and lodged the case next day in the evening.

It has been submitted on behalf of the petitioner that the petitioner is not named in the F.I.R. Further it has been submitted that no incriminating article has been recovered from possession of the petitioner nor the petitioner has been put on T.I. Parade. It is further submitted that the petitioner is in custody since 24.12.2014 as it is evident from the impugned order itself. . On behalf of the State, it has been submitted that the name of the petitioner has figured in the present case in course of investigation.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bhagalpur, in connection with Kotwali (Tilkamanjhi) P.S. Case No. 853 of 2014.
