Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in a case registered for the offence punishable under Sections 365, 379, 419 and 120B of the Indian Penal Code.

It is submitted on behalf of the petitioner that the name of the petitioner has appeared in the statement of Sanju Kumar Nishad, who was apprehended on the spot. No incriminating article has been recovered from the possession of the petitioner nor the petitioner has been put on T.I.P. It is further submitted that Sanju Kumar Nishad, in whose statement the name of the petitioner has appeared, has been granted bail vide Cr. Misc. no. 13954 of 2015. The petitioner has no criminal antecedent and has been in custody since 6.2.2015. Considering the facts and circumstances of

No.24040 of 2015 (2) dt.04-06-2015 2 / 2 this case, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Railway Magistrate, Bettiah, West Champaran at Bettiah, in Motihari Rail P.S. Case No. 2 of 2015 with the following conditions :

1. One of the bailors will be the close relative of the petitioner.

2. The petitioner will not indulge in similar or in any other offence.

3. The petitioner will be well represented in the court.

4. In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned.
