JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the First Information Report with specific accusation that he participated in the present occurrence, in which, two persons are, allegedly, brutally killed by the petitioner and his associates.
The contention on behalf of the petitioner is that the petitioner is in jail custody for more than two years but up till now, the trial could not be concluded and having similar allegation co-accused Ram Babu Prasad has already been granted privilege of bail by a co-ordinate Bench of this Court. Regard being had to the facts and circumstances of
Patna High Court Cr.Misc. No.33034 of 2015 (6) dt.14-12-2015 2/2 the case as well as submission of the parties, I am not inclined to release the petitioner on bail. Hence, his prayer for bail in connection with Sessions Trial No. 404 of 2014 arising out of Rajepur P.S. Case No. 65 of 2008 pending in the Court of learned 4th Additional Sessions Judge, Motihari, District-East Champaran stands rejected.
