JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-01-2019 This application, for grant of anticipatory bail, arises out of Complaint Case No. C-125/2018, disclosing offences under Sections 420 of the Indian Penal Code and Section 138 of the N.I. Act.
Allegation against the petitioner that she took a loan of Rs. 2,50,000/- from the complainant and when the complainant asked for her money, the petitioner issued two cheques, which were dishonored by the Bank on presentation. Submission of learned counsel for the petitioner is that out and out false and fabricated allegations have been levelled against the petitioner and there is no chit of paper to show that petitioner has ever taken any money from the
Patna High Court Cr.Misc. No.2470 of 2019(2) dt.18-01-2019 2/2 complainant. So far alleged two cheques are concerned, her cheque book was lost and she has informed the bank to stop payment, which will appear from the Annexure -2. Heard learned A.P.P. also.
Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Motihari, East Champaran, in connection with Complaint Case No. C-125/2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
