The petitioner is languishing in custody since 10.03.2014 in a case registered for the offences punishable under Sections 147, 148, 149, 341, 342, 382, 353, 504, 307 and 364/511 of the Indian Penal Code.

It is alleged that on information being received that some extremists of Adivasi community variously armed cultivating the land of Millia Educational Trust, Rambagh

Patna High Court Cr.Misc. No.24241 of 2015 (2) dt.21-07-2015 2/3 with intent to grab the same the S.D.O. Sadar, Purnia and S.D.P.O. Sadar, Purnia, A.S.P., Purnia and several police personnel reached at the place of occurrence and tried to pacify the matte. In the meantime, at the instance of this petitioner and Panchu Mahto several Adivasis tried to confine S.D.O. Sadar, Purnia and S.H.O. K. Nagar P.S. with intention to kill them but subsequently Dy. S.P., Dhamdaha and A.S.P., Purnia rescued them. It is submitted by learned counsel for the petitioner that it is a case of protest by mob when accusation has been levelled and other accused persons have been granted anticipatory bail and regular bail vide Cr. Misc. Nos. 6949 of 2014 and 29971 of 2014.

Considering the fact that the investigation has already concluded, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Ad hoc Additional Sessions Judge-VIII, Purnea in connection with Suppl. Sessions Trial No. 213 of 2015 arising out of K. Nagar P.S. Case No. 526 of 2012.

Since the petitioner has serious criminal antecedent, the learned court below will be at liberty to cancel the bail bonds of the petitioner in two eventualities i.e. if he defaults

Patna High Court Cr.Misc. No.24241 of 2015 (2) dt.21-07-2015 3/3 for two consecutive occasions or substantially gets involved in some serious nature of offence.
