Mr. Prabhakar Jha, learned GP-27 appears for the State.

The petitioner in the present is seeking quashing of the F.I.R. being Sheohar P.S. Case No. 21 of 2017 dated 14.02.2017 registered for the offences punishable under Sections 420, 406, 353, 379 of the Indian Penal Code and Sections 3, 4, 5, 6 of the Bihar conduct and Examination Act, 1981.

After some arguments, learned counsel for the petitioner submits that he is not aware of the present stage of the

Patna High Court CR. WJC No.753 of 2017(2) dt.05-08-2022 2/2 investigation and he will be satisfied if this Court allows him to withdraw this application with liberty to challenge, in case occasion so arises, the chargesheet and the order taking cognizance against the petitioner.

Mr. Prabhakar Jha, learned GP-27 for the State has no objection. He is also not aware of the present stage of the investigation.

Considering the aforementioned submissions, this Court allows learned counsel for the petitioner to withdraw this application with liberty to the petitioner that if so advised, he may challenge the order taking cognizance or any subsequent order(s) in accordance with law.
