2. At the outset, learned counsel appearing on behalf of the petitioners seeks permission to withdrawn this anticipatory bail application on behalf of Petitioner No. 3, namely Deepak Kumar, as during pendency of this case, Petitioner No. 3 has already been arrested.
3. Permission, as prayed for, is accorded.
4. Accordingly, this anticipatory bail application on behalf of Petitioner No. 3 stands dismissed as withdrawn.
5. Petitioner Nos. 1, 2 and 4 apprehend their arrest in
Patna High Court CR. MISC. No.4759 of 2025(2) dt.25-02-2025 2/3 a case registered for the offence punishable under Sections 126(2), 115(2), 191(2), 193(3) and 109 of the B.N.S. and Section 27 of the Arms Act.
6. As per prosecution case, while informant was at his house in the meantime, all the F.I.R. named accused persons, including these petitioners, came there and made indiscriminate firing.
7. It is submitted by learned counsel appearing on behalf of the petitioners that petitioners are innocent and have committed no offence. As a matter of fact, on the alleged date and time of occurrence, informant came to house of these petitioners along with other accused persons and made indiscriminate firing as a result of which some persons sustained injuries. It is further submitted that no one from the informant's side sustained any injuries. There is case and counter-case between the parties. Petitioners claim clean antecedents.
8. On the other hand, learned A.P.P. for the State and learned counsel appearing on behalf of the informant have vehemently opposed the prayer for grant of anticipatory bail to the petitioners.
9. Considering the aforesaid facts and circumstances, case and counter-case between the parties and clean antecedents
Patna High Court CR. MISC. No.4759 of 2025(2) dt.25-02-2025 3/3 of the petitioners, the prayer for grant of anticipatory bail to Petitioner Nos. 1, 2 and 4 is allowed.
10. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named Petitioner Nos. 1, 2 and 4 be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Munger in connection with Sangrampur P.S. Case No. 198 of 2024, subject to condition as laid down under Section 482 of the B.N.S.S..
11. With the aforesaid directions, this application stands disposed of.
