The petitioner is languishing in custody since 26.03.2015 in a case registered for the offences punishable under sections 364A, 120B/34 of the Indian Penal Code. The accusation is of kidnapping the son of the informant Vivek Kumar for extortion. It is alleged against the petitioner that the petitioner was sitting in the Bolero vehicle through which the victim was taken.
It is submitted by learned counsel for the petitioner that in 164 Cr.P.C. statement the victim has not named the petitioner. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent and other
Patna High Court Cr.Misc. No.24201 of 2015 (2) dt.14-07-2015 2/2 co-accused have been granted bail by a co-ordinate bench of this Court vide Criminal Miscellaneous Nos.11540 of 2015, 12636 of 2015 and 13078 of 2015.
Considering the abovementioned facts, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Munger in connection with Kharagpur P.S. Case No.152 of 2014.
