Patna High Court Cr.Misc. No.14590 of 2016 (2) dt.18-05-2016 2/3 both the above stated petitions have arisen out of Dumariyaghat P.S. Case No. 18 of 2015 registered for the offences punishable under Section 414/34 of the Indian Penal Code and Sections 20(b), 22, 23, 24 of N.D.P.S. Act and accordingly, both the above stated petitions are being disposed of by this common order. Heard learned counsels for the petitioners as well as learned Additional Public Prosecutor for the State. Earlier the prayer for bail of the petitioners was rejected by this court vide order dated 29.10.2015 passed in Cr. Misc. No. 30531 of 2015 giving liberty to petitioners to renew their prayer for bail after completion of one year in jail custody. Only seven kg.
ganja is said to have been recovered from joint possession of the petitioners for which petitioners are in jail custody since 16.03.2015 and they have already completed one year in jail custody but up till now, their trial could not be concluded. Para-3 of both the petitions goes to show that petitioners do not have any criminal antecedent. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.
