In this case, the petitioner is apprehending his arrest in connection with Basantapur P.S. Case No. 365 of 2018 registered for offences under sections 272/273/308/34 of the Indian Penal Code and Section 30(A)/41(i) of the Bihar Excise Prohibition Act, 2016. In the present case, the police has recovered 46 bottles (each of 180 ml) from the room of the petitioner. Looking to the quantity of liquor recovered as also the entire facts and circumstances of the case, this Court is in inclined to grant privilege of anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail of the petitioner, above named, is rejected.
