JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 2.3.2015 in a case registered for the offences punishable under Section 414 of the IPC and section 47(a) of the Excise Act. From the house of the petitioner 70 gallons of spirit, machines for manufacturing illicit liquor and other incriminating materials were recovered.
It is submitted by the learned counsel for the petitioner that the recovery has been made from the joint family house and the investigation has concluded.
Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/-
Patna High Court Cr.Misc. No.23961 of 2015 (2) dt.13-07-2015 2/2 (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Muzaffarpur in connection with Muzaffarpur Sadar P.S. Case No. 376 of 2013.
Considering the criminal antecedent of the petitioner, the learned court below shall be at liberty to cancel the bail bonds of the petitioner in case the petitioner defaults, without any reasonable cause, on three consecutive occasions. (Dinesh Kumar Singh, J) Anil/- U T
