Petitioner seeks regular bail in a case registered for the offence punishable under Section 20(a), 20(b), 22 of the NDPS Act.

As per the prosecution case, on 06.03.2021 the informant went to village Bambai and got secret information that this petitioner has planted Ganja plant in his courtyard. After lapse of 13 days, on 19.03.2021 the informant came to know that petitioner uprooted the semi dried Ganja plant (3.250 kg) and thrown the same in the field of Raju Sharma. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. No incriminating article has been recovered from the conscious possession of the petitioner and from perusal of FIR

Patna High Court CR. MISC. No.5008 of 2022(2) dt.04-04-2022 2/2 itself it would appear that recovery has been made from the field of Raju Sharma. Petitioner claims clean antecedent and is in custody since 24.03.2021 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge, Jehanabad in connection with Pali PS case No.14/2021.
