The present application has been filed for modification of the order dated 21-12-2018 passed in Cr. Misc. No. 61308 of 2018 by which the petitioner was granted anticipatory bail in connection with Bihar P.S. Case No. 229 of 2018 pending in the court of learned Chief Judicial Magistrate, Nalanda and the petitioner was directed to surrender and furnish bail bond in the court below within a period of six weeks.

It is submitted on behalf of the petitioner that inadvertently, in the 8th line of fourth paragraph of the order dated 21-12-2018 passed in Cr. Misc. No. 61308 of 2018, it has wrongly been mentioned that

Patna High Court CR. MISC. No.3737 of 2020(2) dt.22-01-2020 2/2 "During the pendency of the said application before the Registrar of the Society, two of those members died". As a matter of fact, during the pendency of the said application before the Registrar of the Society, one of the members namely, Sri Ramashraya Prasad died.

Considering the submissions made on behalf of the learned counsel for the petitioner and the grounds mentioned in the modification application, this modification application is allowed to the extent that in the 8th line of fourth paragraph of the order dated 21-12-2018 passed in Cr. Misc. No. 61308 of 2018, the sentence "during the pendency of the said application before the Registrar of the Society, two of those members died", be read as "during the pendency of the said application before the Registrar of the Society, one of the members namely, Sri Ramashraya Prasad died". The rest of the conditions shall remain the same as mentioned in the order dated 21-12-2018 passed in Cr. Misc. No. 61308 of 2018. The modification application is, accordingly, disposed of.
