JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-435, 427 & other minor sections of the Indian Penal Code and under Section-27 of the Arms Act as also, Sections-3/4 of Explosive Substances Act.

Petitioner is not named in the first information report and submission on behalf of petitioner is that the name of petitioner came in this case after one year of the alleged occurrence, in confessional statement of the co-accused and except the so-called confessional statement as well as some criminal antecedent, there is nothing against him.

Considering the above-said facts and circumstances of

Patna High Court Cr.Misc. No.14364 of 2016 (2) dt.07-04-2016 2/2 the case as well as submission of the parties and also, taking note of this fact that the investigation against the petitioner has already been completed, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Banka P.S. Case No. 402 of 2014 to the satisfaction of learned Chief Judicial Magistrate, Banka.
