Petitioner apprehends arrest in connection with Barahra P.S. Case No. 450 of 2019 registered for the offence punishable under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case. Nothing has been recovered from the conscious possession of this petitioner. The alleged recovery is said to have been made from an open place beside the road as is evident from the seizure list. Petitioner is a man of clean antecedent.

Sessions Judge-cum-Special Judge, Excise Act, Buxar in connection with Barahra P.S. Case No. 450 of 2019 subject to the conditions laid down under section 438(2) Cr.P.C.
