The petitioner is in custody in a case registered under Sections 20 and 22 of N.D.P.S.Act.

The prosecution case in, brief, is that on 30.03.2014 at about 14 hours a search was made by the informant at Machhali Market, Saharsa and Ganja like substance was recovered containing in 44 big and 92 small pockets measuring about 1 kg. along with other article from a Gumti situated at Machhali Market, Saharsa and informant alleged that petitioner wa succeeded in fleeing.

It has been submitted on behalf of the petitioner that the petitioner has no criminal antecedent .As per prosecution, it is

Patna High Court Cr.Misc. No.24011 of 2015 (2) dt.06-07-2015 alleged that 1 Kg. Ganja is said to have been recovered from the Gumti of the petitioner, which is less than small quantity. He is in custody since 22.4.2015.

On behalf of the State, it is submitted that the petitioner is named in the FIR.

Considering the facts aforesaid, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum- Special Judge, N.D.P.S. Act, Saharsa in Special Case No. 7/2014 arising out of Saharsa P.S.Case No. 197 of 2014.
